    Knowing whether or not the Soul caused the accident or driver error trumps "family privacy." the edr info could prove useful to other drivers. no one claims "family privacy" when it comes to the black box readings in plane crashes. -_-

    and the Houston chronicle article that I read first said it was a support pillar and that he was pinned under it. but the chronicle is about as reliable as MSNBC or fox news to tell you the truth. but the Chron didn't have any pictures, so I linked you guys to the khou site.

    it does look to be a barrier, not a support pillar though. sorry for the confusion.

    My apologies for thinking that the safety of others trumps the embarrassment a few family members may have if the fact that Cousin Johnny may have been driving drunk was made public. Edr records should be made public. Period. If it turns out he was speeding, bummer. If it turns out it was a computer malfunction that caused the accident, could possibly save all of our asses. It's no different than plane crashes. The fact that the deceased may or may not own the vehicle has NOTHING to do with the fact that people need to know what happened. It could help prevent the same from happening to others.

    This is a matter of individual state law, period. There are privacy, liability, and private property issues.

    Federal law covers aircraft crashes. Different kettle of fish.

    Making all records public record is a very bad idea in a Constitutional Republic.

    Blood tests will give tox results. Crash reconstruction specialists can determine speed within a few MPH.

    People who wholesale publish records, for instance the NY newspaper that published addresses of gun owners, are opening themselves to huge lawsuits and unintended consequences that are unpredictable.
    Numerous statutes and court decisions give us some expectation of privacy.

    This will work itself out.
